Welcome to Despatchy! By using our app, you agree to the following terms and conditions:

1. You allow Despatchy to collect your GPS location information when the app is in use. This information is used to provide you with location-based services, such as delivery estimates and real-time tracking of your orders.
2. You acknowledge that the accuracy of your GPS location information may be affected by factors such as your device’s settings, available satellite signals, and your physical location. Despatchy cannot guarantee the accuracy of your GPS location information at all times.
3. You understand that the use of location-based services may cause your device to consume additional battery power. Despatchy is not responsible for any loss of battery life or damage to your device as a result of using our app.
4. You agree to allow Despatchy to store and use your GPS location information in accordance with our privacy policy. We will never sell your location data to third parties for their marketing purposes.
5. You understand that you can disable the location tracking feature in your device’s settings at any time. However, doing so may limit the functionality of our app and the services we are able to provide to you.
6. You agree to use our app and services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of our app by, any third party.
7. You are responsible for maintaining the confidentiality of your account information, including your login credentials, and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
8. Despatchy reserves the right to modify, suspend, or terminate your access to our app and services at any time, without notice and without liability, for any reason or no reason.
9. Despatchy provides our app and services “as is” and makes no representations or warranties of any kind, express or implied, as to the operation of our app or the information, content, materials, or products included on it.
10. Despatchy will not be liable for any damages of any kind arising from the use of our app or services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
11. These terms and conditions shall be governed by and construed in accordance with the laws of QLD-Australia. Any disputes arising under or in connection with these terms and conditions shall be resolved through binding arbitration in Queensland Australia.
12. You agree to indemnify and hold Despatchy, our affiliates, and our and their respective officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our app and services, your violation of these terms and conditions, or your violation of any rights of another.
13. Despatchy may provide links to third party websites or resources. You acknowledge and agree that we are not responsible or liable for the availability or accuracy of such websites or resources, and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or resource.
14. These terms and conditions constitute the entire agreement between you and Despatchy and govern your use of our app and services, superseding any prior agreements. If any provision of these terms and conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
15. You may not assign or transfer these terms and conditions or your rights and obligations hereunder, in whole or in part, without the prior written consent of Despatchy. Despatchy may assign or transfer these terms and conditions, in whole or in part, without your consent, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
16. You understand and agree that Despatchy may collect and store your timesheet and job details when you use our app to track your work hours and tasks. This information may be used for payroll and billing purposes, as well as to improve the functionality and performance of our app.
17. You acknowledge that the accuracy of your timesheet and job details is your responsibility. You agree to provide accurate and complete information when using our app to track your work.
18. You understand that Despatchy will not be liable for any errors or inaccuracies in your timesheet and job details, or for any loss of data resulting from the use of our app. You are responsible for regularly backing up your data and for taking appropriate measures to protect it from loss or damage.
19. You acknowledge and agree that Despatchy may retain and use your timesheet and job details in accordance with our privacy policy and as required by applicable laws and regulations.
20. You understand that the internet and mobile applications are not completely secure, and that Despatchy cannot guarantee the security of your personal or confidential information. You acknowledge and agree that you are using our app and services at your own risk.
21. You understand that Despatchy will not be liable for any unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through our app.
22. You agree to immediately notify Despatchy of any unauthorized use of your account or any other breach of security.
23. You acknowledge that Despatchy will not be liable for any loss or damage arising from your failure to comply with this section.
24. You understand that Despatchy may collect and store your personal information, such as your name, email address, phone number, and location data, when you use our app and services. This information may be used to provide you with personalized experiences, to improve the functionality of our app, and to communicate with you about your account and transactions.
